Terms and Conditions of the Raffle
Rich’s Arubian Dish & Caribbean Delight
1. Organizer
This raffle is organized by Rich’s Arubian Dish & Caribbean Delight, located at:
L.G. Smith Boulevard 330, Local no. 13, Aruba

2. Eligibility
Participation is open to all individuals over 18 years of age residing in or visiting Aruba at the time of purchase and the draw.
Employees of the organizer and their immediate family members are not eligible to participate.
3. Tickets and Price
Each ticket costs twenty-five Aruban Florins (AWF 25.00).
Tickets will be sold until the limit set in clause 8 is reached, or until a deadline determined by the organizer.
The organizer is not responsible for lost, stolen, or damaged tickets.
Only the physical/digital ticket held by the participant at the time of the draw will be valid.
4. The Prize
The prize consists of one (1) automobile, specifically the vehicle published and detailed on the official website and/or social media of Rich’s Arubian Dish & Caribbean Delight at the time of the promotion.
The car may be new or pre-owned and will be delivered in “as-is” condition as displayed.
The winner cannot request a color change, model change, or exchange the prize for cash.
5. Raffle Mechanics
Sales Goal:
The draw will only take place if a minimum of one thousand five hundred (1,500) tickets are sold.
Date Announcement:
Once the goal of 1,500 tickets is reached, the organizer will announce the date and time of the draw within a maximum of fifteen (15) days via its official social media channels and local media.
Broadcast:
The draw will be broadcast live via Instagram and/or Facebook Live to guarantee transparency.
6. Winner Selection
The winner will be selected randomly through a raffle drum, digital wheel, or any other random draw method determined and previously communicated by the organizer.
The result is final and binding.
7. Claiming the Prize
The winner must be present (or have a legally authorized representative with a notarized power of attorney) at the time of the draw to claim the prize.
If the winner is not present and has no representative, a new draw will be held immediately to select a new winner.
This process will be repeated until the prize is claimed.
The winner must present a valid ID (Aruban ID or Passport) and the original winning ticket.
8. Winner’s Obligations (Publicity)
As part of the prize, the winner agrees to display a “Rich’s Arubian Dish & Caribbean Delight” promotional sticker on the vehicle for a period of six (6) consecutive months from the date of delivery.
The sticker must be placed in a visible location (e.g., rear or side windows) as agreed with the organizer.
Failure to comply with this clause may result in legal action by the organizer to recover the value of the prize or damages incurred.
9. Vehicle Delivery
Physical delivery of the vehicle will take place within thirty (30) business days after the draw, once the winner has met the requirements of clause 7 and signed the corresponding delivery document.
All costs related to title transfer, insurance, taxes (such as BPM or circulation tax), and maintenance after delivery are the sole responsibility of the winner.
10. Modifications and Force Majeure
The organizer reserves the right to modify these terms and conditions due to force majeure or unforeseen events, committing to communicate any such changes to the participants as soon as possible.
11. Acceptance of Terms
The purchase of a ticket implies full knowledge and acceptance of these terms and conditions.

2. Participación
La participación en esta rifa está abierta a todas las personas mayores de 18 años que residan o se encuentren en Aruba al momento de la compra y del sorteo.
Los empleados del organizador y sus familiares directos no podrán participar.
3. Boletos y Precio
Cada boleto tiene un valor de veinticinco florines arubanos (AWF 25,00).
Los boletos se venderán hasta alcanzar el límite establecido en la cláusula 8, o hasta la fecha límite que el organizador determine.
El organizador no se hace responsable por boletos perdidos, robados o dañados.
Solo será válido el boleto físico/digital en poder del participante en el momento del sorteo.
4. El Premio
El premio consiste en un (1) automóvil, específicamente el vehículo que se encuentra publicado y detallado en la página web oficial y/o redes sociales de Rich’s Arubian Dish & Caribbean Delight en el momento de la promoción.
El auto podrá ser nuevo o seminuevo, y se entregará en el estado en que se exhibe.
El ganador no podrá exigir cambios de color, modelo, ni la entrega del valor en efectivo.
5. Mecánica de la Rifa
Meta de Venta:
El sorteo se realizará únicamente si se logra vender un mínimo de mil quinientos (1,500) boletos.
Anuncio de la Fecha:
Una vez alcanzada la meta de 1,500 boletos vendidos, el organizador publicará la fecha y hora del sorteo en un plazo máximo de quince (15) días a través de sus redes sociales oficiales y medios locales.
Transmisión:
El sorteo se realizará en vivo a través de Instagram y/o Facebook Live para garantizar la transparencia del proceso.
6. Selección del Ganador
El ganador será seleccionado al azar mediante tómbola, ruleta digital, o cualquier otro método de sorteo aleatorio que el organizador determine y comunique previamente.
El resultado será inapelable.
7. Reclamación del Premio
El ganador debe estar presente (o contar con un representante legalmente autorizado con una carta poder notariada) en el momento del sorteo para reclamar el premio.
Si el ganador no se encuentra presente y no tiene representante, se procederá a realizar un nuevo sorteo en el mismo acto para seleccionar a un nuevo ganador, y así sucesivamente hasta que el premio sea reclamado.
El ganador deberá presentar su cédula de identidad (pasaporte o cédula arubana) válida y el boleto original ganador.
8. Obligaciones del Ganador (Publicidad)
El ganador se compromete, como parte del premio, a exhibir un sticker publicitario de “Rich’s Arubian Dish & Caribbean Delight” en el vehículo durante un período de seis (6) meses consecutivos a partir de la entrega del mismo.
El sticker deberá colocarse en un lugar visible (ej. en la luna trasera o laterales) acordado con el organizador.
El incumplimiento de esta cláusula podrá resultar en acciones legales por parte del organizador para recuperar el valor del premio o los daños y perjuicios ocasionados.
9. Entrega del Vehículo
La entrega física del vehículo se realizará dentro de los treinta (30) días hábiles posteriores al sorteo, una vez el ganador haya cumplido con los requisitos de la cláusula 7 y firmado el acta de entrega correspondiente.
Todos los costos de transferencia de propiedad, seguro, impuestos (como el BPM o impuesto de circulación) y mantenimiento posteriores a la entrega serán de exclusiva responsabilidad del ganador.
10. Modificaciones y Fuerza Mayor
El organizador se reserva el derecho de modificar estos términos y condiciones por causas de fuerza mayor o caso fortuito, comprometiéndose a comunicar dichos cambios a los participantes a la mayor brevedad posible.
11. Aceptación de los Términos
La compra de un boleto implica el conocimiento y la aceptación total de estos términos y condiciones.
